These Terms and Conditions govern the purchase and use of products offered through the Pontovia website and/or online store.
By accessing the website, placing an order or purchasing a product from Pontovia, you agree to be bound by these Terms and Conditions.
Please read them carefully before completing your purchase.

Hereinafter referred to as “Pontovia”, “we”, “us” or “our”.
2. PRODUCTS
Pontovia specialises in decorative artwork and printable wall art, primarily supplied as downloadable digital files.
Unless expressly stated otherwise on the relevant product page:
- all products are digital products;
- no physical product will be shipped;
- frames, furniture and decorative objects shown in product photographs or mockups are not included;
- customers are responsible for printing the purchased files themselves or through a third-party printing service.
Each product page provides information regarding the files included, dimensions, aspect ratios, formats and other relevant characteristics where applicable.
Customers should review the product description carefully before purchasing.
3. PRODUCT IMAGES AND MOCKUPS
Product images, room scenes, frames and interior mockups are used for illustrative and presentation purposes.
The appearance of the final printed artwork may vary depending on factors including:
- screen settings;
- monitor calibration;
- printer;
- printing method;
- ink;
- paper or printing material;
- print size;
- third-party printing services.
Slight differences in colour, contrast, brightness or appearance between the digital preview and the final printed product do not necessarily constitute a defect.
Unless specifically stated otherwise, decorative objects, frames and other elements visible in mockups are not part of the purchase.
4. PLACING AN ORDER
By placing an order, the customer confirms that:
- the information provided during checkout is accurate and complete;
- they have reviewed the product description;
- they understand whether the product is digital or physical;
- they understand the price and any applicable taxes or charges;
- they agree to these Terms and Conditions.
Before completing the order, customers are responsible for reviewing their order and correcting any errors.
An order is considered accepted once payment has been successfully processed and an order confirmation or equivalent confirmation has been issued.
Pontovia reserves the right to reject or cancel an order in cases of obvious pricing errors, suspected fraud, payment failure, technical errors or other legitimate circumstances, subject to applicable consumer law.
If Pontovia cancels an order after payment has been received, the corresponding amount will be refunded where applicable.
5. PRICES AND TAXES
Prices are displayed in the currency indicated on the website or marketplace.
Applicable taxes, including VAT where required, will be calculated or displayed in accordance with applicable law and the checkout system used by the store.
Where a marketplace, payment provider or other intermediary is legally responsible for collecting and remitting applicable taxes, such taxes may be handled directly by that provider.
The total price payable by the customer will be shown before the order is completed.
Pontovia reserves the right to change prices at any time. Price changes will not affect orders that have already been accepted.
6. PAYMENT
Payment must be made using one of the payment methods available during checkout.
Payments may be processed by third-party payment providers.
Pontovia does not necessarily receive or store complete payment card details when payments are processed through an external payment provider.
The customer is responsible for ensuring that they are authorised to use the payment method selected.
An order may be cancelled or suspended if payment is declined, reversed, disputed or otherwise unsuccessful.
7. DIGITAL DELIVERY
Digital products are normally made available after successful payment through one or more of the following methods:
- an immediate download page;
- a download link;
- an email containing access or download information;
- the customer’s account;
- the platform or marketplace through which the purchase was made.
No physical item will be delivered unless the product description expressly states otherwise.
The customer is responsible for providing a valid email address and for maintaining access to the email account or customer account used for the purchase.
Customers are encouraged to download and securely store their purchased files after completing the purchase.
Pontovia does not guarantee that download links or third-party platform access will remain available indefinitely unless expressly stated otherwise.
8. RIGHT OF WITHDRAWAL FOR DIGITAL CONTENT
Consumers may have a statutory right of withdrawal under applicable consumer protection legislation.
However, special rules apply to digital content supplied without a physical medium.
Where the customer requests or expressly agrees to receive immediate access to digital content before the expiry of the applicable withdrawal period, the customer may be required to:
- expressly consent to the performance of the contract beginning immediately; and
- acknowledge that, once the supply of the digital content has begun in accordance with applicable law, they will lose their statutory right of withdrawal.
Where all legal requirements for the loss of the right of withdrawal have been fulfilled, the customer will no longer be entitled to cancel the purchase merely because they have changed their mind after access to or delivery of the digital content has begun.
This provision does not affect any statutory rights the customer may have where digital content is defective, incorrect, inaccessible or otherwise fails to conform to the contract.
9. REFUNDS AND DIGITAL PRODUCTS
Due to the nature of downloadable digital products, purchases are generally final once the digital content has been supplied and the applicable legal conditions regarding the loss of the withdrawal right have been satisfied.
Pontovia does not offer refunds solely because:
- the customer changed their mind after receiving the files;
- the customer purchased the wrong product without an error attributable to Pontovia;
- the customer expected a physical product where the listing clearly stated that the product was a digital download;
- the customer lacks the software, equipment or printing service required to use the files;
- colours vary slightly between a screen and a printed result;
- a third-party printer produces an unsatisfactory result that is not caused by a defect in the supplied digital file.
Nothing in these Terms limits or excludes any mandatory consumer rights.
If a file is corrupted, incomplete, incorrect or cannot be accessed because of an issue attributable to Pontovia, please contact us at:
contact@pontovia.com
Please include your order number and a description of the problem.
Where appropriate, Pontovia will provide a corrected file, replacement download or another remedy required under applicable consumer law.
10. DIGITAL FILE LICENCE
Unless the relevant product page expressly states otherwise, purchasing a Pontovia digital product grants the customer a limited, non-exclusive, non-transferable licence for personal use only.
The purchase does not transfer ownership of the copyright or intellectual property rights in the artwork.
Customers may:
- download the purchased files for their own personal use;
- print the artwork for display in their own home or personal spaces;
- use a professional printing company to print the artwork on their behalf for personal use;
- print the artwork as a personal gift, provided that no commercial benefit is obtained.
Unless Pontovia expressly grants a commercial licence, customers may not:
- resell digital files;
- redistribute digital files;
- share purchased files with third parties;
- upload files to file-sharing websites or databases;
- make the files available for free or paid download;
- sell physical prints made from the files;
- use the artwork on products offered for sale;
- use the artwork for print-on-demand products;
- use the artwork as part of merchandise;
- modify the artwork and sell the modified version;
- claim the artwork as their own;
- sublicense or transfer the files;
- use the files as part of another digital product for resale;
- use Pontovia artwork, substantially unchanged or modified, for commercial exploitation without written permission.
A separate commercial licence may be offered for certain products. Where a specific licence accompanies a product, the terms of that licence will apply.
11. INTELLECTUAL PROPERTY
All intellectual and industrial property rights relating to Pontovia products and website content remain the property of Pontovia or their respective authorised rights holders.
This includes, where applicable:
- artwork;
- photographs;
- digital compositions;
- designs;
- collections;
- product images;
- mockups created by Pontovia;
- graphics;
- logos;
- branding;
- texts;
- downloadable files;
- website content.
The purchase of a product does not transfer copyright or other intellectual property rights to the customer.
Unauthorised reproduction, distribution, resale, commercial exploitation or publication may constitute an infringement of intellectual property rights and may result in appropriate legal action.
12. PROHIBITED USE
Customers and website users must not use Pontovia products or content:
- for unlawful or fraudulent purposes;
- in violation of intellectual property rights;
- to impersonate Pontovia or falsely imply an association with Pontovia;
- to redistribute or commercially exploit protected content without permission;
- to remove copyright notices, watermarks or other ownership information from preview material for unauthorised use;
- to circumvent technological or other measures intended to protect downloadable content.
Pontovia reserves the right to take reasonable action to protect its intellectual property where unauthorised use is detected.
13. TECHNICAL REQUIREMENTS
The customer is responsible for ensuring that they have suitable equipment, software and services to download, open and print the purchased files.
Product descriptions may specify formats such as JPEG, PNG, PDF or other digital file types.
The customer should verify compatibility before completing the purchase.
If specific technical requirements apply to a product, they will be indicated in the relevant listing where appropriate.
14. PRINTING
Pontovia supplies digital artwork unless otherwise expressly stated.
Printing is normally carried out by the customer or by a third-party printing provider selected by the customer.
Pontovia is not responsible for errors, delays, colour variations, cropping, print quality or other problems caused by an independent printing provider, printer settings or materials selected by the customer.
Customers should verify dimensions, proportions and print settings before ordering prints, especially when using third-party printing services.
15. PROMOTIONAL CODES AND DISCOUNTS
Pontovia may occasionally offer promotional codes, discounts or special offers.
Unless otherwise stated:
- promotional codes cannot be exchanged for cash;
- they cannot be applied retrospectively to completed purchases;
- they may have expiration dates or specific eligibility conditions;
- only one promotional code may be used per order where the checkout system imposes such a limitation.
Pontovia may withdraw or modify promotional offers where legally permitted.
16. THIRD-PARTY SERVICES
The Pontovia website or store may rely on third-party services including:
- website hosting providers;
- e-commerce platforms;
- marketplaces;
- payment processors;
- email providers;
- cloud storage services;
- analytics providers;
- download-delivery systems.
The use of certain third-party services may also be subject to the terms and privacy policies of those providers.
Pontovia is not responsible for outages, errors or failures caused exclusively by third-party providers outside Pontovia’s reasonable control, without prejudice to any rights that consumers may have under mandatory law.
17. WEBSITE AVAILABILITY
Pontovia aims to maintain the website and digital delivery systems in good working order but cannot guarantee uninterrupted or error-free availability at all times.
Access may occasionally be suspended or limited because of:
- maintenance;
- updates;
- technical failures;
- security incidents;
- third-party service interruptions;
- circumstances outside Pontovia’s reasonable control.
Where an interruption affects a completed purchase, Pontovia will take reasonable steps to restore access or provide an appropriate solution.
18. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.
Subject to applicable mandatory consumer rights, Pontovia shall not be responsible for losses resulting exclusively from:
- improper use of the purchased files;
- incompatibility not caused by incorrect information supplied by Pontovia;
- printing errors attributable to third-party printers;
- unauthorised modification of the files;
- failure by the customer to follow clearly stated product specifications or instructions;
- circumstances outside Pontovia’s reasonable control.
Pontovia’s products are intended primarily for decorative purposes unless expressly stated otherwise.
19. CUSTOMER RESPONSIBILITY
Customers are responsible for:
- reviewing product descriptions before purchasing;
- entering correct contact and payment information;
- downloading the correct files;
- selecting appropriate print sizes and ratios;
- ensuring compatibility with their intended printing method;
- complying with the licence attached to the purchased product;
- retaining a personal backup of downloaded files where reasonably possible.
20. CHANGES TO PRODUCTS AND SERVICES
Pontovia may modify, update, discontinue or replace products offered in the store.
Such changes will not affect the customer’s rights relating to a product already purchased.
Minor changes may also be made to digital products where necessary to correct technical errors or improve compatibility, provided that such changes do not unlawfully reduce the customer’s rights.
21. CHANGES TO THESE TERMS
Pontovia may update these Terms and Conditions when necessary to reflect:
- changes in applicable law;
- changes to the store or services;
- new payment or delivery systems;
- operational changes;
- new product types;

The version applicable to a purchase will generally be the version in force when the order was placed, without prejudice to changes required by mandatory law.
The current version will always display its latest revision date.
22. PRIVACY
Personal data collected through the website and during the purchasing process is handled in accordance with Pontovia’s Privacy Policy.
Customers should review the Privacy Policy for information regarding how personal information is collected, used, stored and protected.
23. COOKIES
The website may use cookies and similar technologies.
Further information regarding cookies and user choices is available in Pontovia’s Cookie Policy.
24. GOVERNING LAW AND CONSUMER RIGHTS
These Terms and Conditions are governed by Spanish law.
If the customer is a consumer residing outside Spain, nothing in these Terms is intended to deprive them of mandatory consumer protection rights that apply to them under applicable law.
Any dispute involving a consumer shall be handled in accordance with the mandatory rules on jurisdiction and consumer protection that apply to that consumer.
Nothing in these Terms limits any statutory rights that cannot legally be waived or restricted.
25. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary, where legally possible.
The remaining provisions shall continue in effect.
26. ENTIRE AGREEMENT
These Terms and Conditions, together with the applicable product description, Privacy Policy, Cookie Policy, Legal Notice and any specific licence terms communicated before purchase, constitute the terms applicable to the relevant transaction, subject to applicable mandatory law.
